In its battle against copyrighted downloads, the RIAA set-up a system where those accused of illegal file sharing can opt-out of a lawsuit by simply paying a few thousand dollars. It served as easy escape for those who were accused. If found guilty in court, the defendants would have to pay a considerably larger fine; possibly millions instead of thousands.
Going to court would be a huge risk, but it was a risk that Jammie Thomas is will to take. She challenged the RIAA by refusing to settle out of court. The jury trial, which begins today, will be the first that the RIAA has had to partake in. The outcome of this trial will set a precedent.
